Arrrh Hope it all turns out ok. A sod this type of thing and unnecessary worry. hope it turns out as soon as possible in the best way possible. Money is one thing but losing trust is the worst.

Well, I've had a response:

"I'm sorry to bring you trouble,
when we receive the silver camera, I'll refund you through paypal
Ok?
regards"

Not OK, really, as the silver camera has nothing to do with me. It would be easier and less confrontational for me to say, OK. But what happens if the silver camera gets lost or damaged?

"No, I'm not happy about that. The silver camera has nothing to do with me. What if it got damaged in transit, or lost? And it might take a long time to get back to you. This problem was created by you. Please refund me now."

Grrr...getting annoyed now.

Sorry to hear Rob, the hardest I know is trying to get it out your mind and take a break from it. I am guessing PayPal or e-bay wont intervene until a certain time has elapsed? If it was a credit card, I'd phone my bank and ask advice?

The upside in this is that I believe you would ultimately receive a refund from Ebay through their Buyer Protection policy unless you receive the exact item in the advertised condition you purchased. Of course, that could take quite a while to play out. Assuming you do not get a refund in the next 24 hours from this guy, I would contact Ebay and see if you can start a dispute due to him admitting he sent you the wrong item and that he shipped your item to someone else.

I know the general consensus lately is that Ebay/Paypal's policies are weighted in favor of the buyer - I've heard far more horror stories about sellers getting hosed by dishonest buyers with Ebay not doing anything than buyers getting buggered by sellers.

You might not like the timeline, but I think the worst case is you getting your money back or the camera you purchased in the advertised condition, but on a timeline that is longer than it should be. Best case is the seller is a stand-up guy and resolves this ASAP.
 
Agreed. No reply yet, but I'll wait until tomorrow before contacting eBay. It's his fault, not mine, so he should come clean and give me a refund.

This guy is an ass! What nerve he has to expect you to wait!
 
Well, this has been going on for one month now. Quick recap: bought a Konica Hexar on eBay. The guy sent it to someone else, but refused to return my money until he received back another camera he sent to me by mistake. I stopped that camera at Customs, so that I wouldn't have to pay import duty on it. He still refused to refund me. I took the next step which was to launch a Dispute. He still refused, so two days ago I Escalated the case, to use eBay terminology. eBay found in my favour, and immediately released the funds they had frozen from his account.

I won.

I don't feel very victorious. eBay have encouraged me to leave appropriate feedback on the guy's business dealings, "to help others be aware of his actions". Damn right I will!
